How to upload a video to Youtube without Viacom copyright infringement error?

I am trying to upload a video which I have already edited by adding subtitles and changing the audio. Yet when I attempt to upload it to youtube I get a Viacom copyright infringement error message. What is the best way to avoid detection by viacom because technically I have created my own video but for some reason I can't change the licensing of the video. Isn't there a way to re-record the video so that Youtube would not detect the video as being licensed and me infringing on their copyright (because I am not!!!)
